1. Agreement

These Terms of Service ("Terms") govern your access to and use of the website at lionsservices.org ("Website") operated by Lions Services, Inc. ("Lions Services," "we," "us," or "our"), a 501(c)(3) tax-exempt nonprofit organization registered in North Carolina. By accessing or using this Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

2. Scope of Information

Content on this Website is provided for general informational purposes about Lions Services' programs, services, and mission to empower people who are blind or have vision loss. Program eligibility, hours, pricing for B2B manufacturing services, and event details shown on the Website are subject to change. Specific commitments are confirmed in writing through individual program enrollment, employment offers, or signed B2B service agreements.

3. Acceptable Use

You agree to use the Website only for lawful purposes. You may not:

  • Attempt to interfere with or disrupt the Website, its servers, or networks.
  • Upload or transmit viruses, malware, or other harmful code.
  • Scrape, copy, or republish substantial portions of the content without written permission.
  • Impersonate another person or misrepresent your affiliation.
  • Submit false information through any contact, donation, application, or volunteer form.

4. Intellectual Property

All content on this Website, including text, photographs, logos, graphics, videos, page layouts, and the underlying code, is the property of Lions Services or its licensors and is protected by United States copyright, trademark, and other intellectual-property laws. The Lions Services name and logo are trademarks of Lions Services, Inc.

5. User-Submitted Content

If you submit photos, project details, testimonials, employment-application materials, or other content to us through a form or email, you grant us a non-exclusive, royalty-free license to use that content for the purpose of responding to your inquiry, processing your application or donation, or completing the engagement you requested. We will not publicly publish recognizable photos or quote you without your permission.

6. Donations

Donations to Lions Services are processed by Zeffy. Lions Services, Inc. is a 501(c)(3) tax-exempt nonprofit; contributions are deductible to the extent permitted by law. Please retain your Zeffy receipt for tax purposes. For our IRS determination letter, contact info@lionsservices.org.

7. B2B Manufacturing Services

Lions Services operates as a NIB AbilityOne contractor providing manufacturing, assembly, and packaging services to federal and commercial customers. Specific contract terms, pricing, delivery, warranty, and indemnification provisions for B2B engagements are governed exclusively by individually signed service agreements between Lions Services and the customer, not by these Website Terms. In the event of any conflict, the signed agreement controls for the services it covers.

8. Disclaimers

The Website is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the content for any particular purpose. Photographs and stories are representative; individual program outcomes vary. Information on the Website is not a substitute for professional medical, vocational rehabilitation, or legal advice.

9. Limitation of Liability

To the fullest extent permitted by law, Lions Services and its directors, officers, employees, volunteers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Website, even if we have been advised of the possibility of such damages. Our total liability arising out of or relating to your use of the Website is limited to one hundred dollars ($100).

This limitation does not apply to liability for completed program services or B2B service work, which is governed by your individual program enrollment, employment agreement, or signed service agreement and applicable North Carolina law.

The Website may contain links to third-party websites or services that are not owned or controlled by us, including Zeffy (donations), social-media platforms, and resource sites for the blind and low-vision community. We are not responsible for the content, privacy practices, or accuracy of any third-party website. Linking to a third party does not imply endorsement.

Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to These Terms

We may revise these Terms at any time by updating this page. The "Last updated" date above indicates when the current version took effect. Your continued use of the Website after changes means you accept the revised Terms.

13. Governing Law

These Terms and any dispute arising from your use of the Website are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction of those courts.

14. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy and any signed program, employment, or B2B service agreement, constitute the entire agreement between you and Lions Services regarding your use of the Website and supersede any prior agreements, representations, or understandings on the same subject. Signed program, employment, or service agreements between you and Lions Services control for the specific services they cover in the event of any conflict with these Terms.

Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the remaining provisions of these Terms shall continue in full force and effect.

Termination

We may suspend or terminate your access to the Website, at our sole discretion and without prior notice, for any violation of these Terms. Provisions that by their nature should survive termination, including Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, and Indemnification, will remain in effect.

No Waiver

Our failure to enforce any right or provision of these Terms on any particular occasion shall not be deemed a waiver of that right or provision, nor a waiver of any subsequent breach.

Indemnification

You agree to indemnify, defend, and hold harmless Lions Services, its directors, officers, employees, volunteers, contractors, agents, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your misuse of the Website; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit to us through the Website.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

Force Majeure

Neither party shall be liable for any failure or delay in performance caused by circumstances beyond reasonable control, including acts of God, natural disasters, severe weather, war, civil unrest, labor disputes, government action, or utility or telecommunications failures.
